Definitions

In these Terms, unless the context otherwise requires:
“InkPig” means Black Press Limited trading as InkPig, its employees, contractors, and authorised representatives.
“Customer” means any individual purchasing goods through the InkPig website.
“Website” means the InkPig website and any associated ecommerce platform operated by InkPig.
“Products” means printed goods and related items offered for sale by InkPig.
“Artwork” means any files, designs, images, text, or other materials supplied by the Customer for printing.
“Proof” means any digital or physical sample supplied for review prior to production.
“Dispatch” means the point at which Products leave InkPig’s control for delivery to the Customer.
“Terms” means these Website Terms of Use and Terms of Trade, as amended from time to time. “Bulk Order” means any order exceeding 1,000 units or 25kg in total weight.

1. Acceptance of Terms

These Terms govern all use of the Website and all purchases made through InkPig.

By accessing the Website or placing an order, the Customer agrees to be bound by these Terms. These Terms apply to the exclusion of any other terms or conditions.

InkPig reserves the right to amend these Terms at any time. The version in force at the time an order is placed will apply to that order.

2. Website Use

All content on the Website, including text, images, designs, branding, and layout, is owned by InkPig or its licensors and is protected by intellectual-property laws.

The Website and its content are provided on an “as is” basis. InkPig does not warrant that the Website will be uninterrupted, error-free, or free from inaccuracies.

InkPig may update, suspend, or withdraw any part of the Website at any time without notice.

3. Orders

All orders placed through the Website are subject to acceptance by InkPig.

Once payment is successfully received, the order is deemed accepted and approved for production. Orders cannot be cancelled or amended once production has commenced.

InkPig reserves the right to refuse or cancel any order at its discretion, including where content is unlawful, offensive, or inappropriate.

4. Proofs and Approval

Where a Proof is supplied, the Customer is solely responsible for reviewing and approving all details, including spelling, layout, sizing, colours, and content.

Approval of a Proof constitutes confirmation that the Artwork is correct in every respect. InkPig shall not be liable for errors present in an approved Proof.

In some cases, InkPig may proceed to production without supplying a Proof. Where no Proof is supplied, the Customer accepts responsibility for the accuracy of the submitted Artwork.

5. Artwork and File Responsibility

The Customer is responsible for supplying print-ready Artwork that meets InkPig’s file specifications.

InkPig is not responsible for errors or defects arising from Customer-supplied Artwork, including but not limited to:

• spelling or grammatical errors
• low-resolution images
• incorrect sizing, bleed, or colour setup
  

Minor variations in colour, trimming, finish, or texture are inherent in printing processes and are considered commercially acceptable.

Due to differences in screens, substrates, inks, laminates, and production processes, exact colour matching cannot be guaranteed.

Artwork & Order Delays

Where a Customer fails to respond to proofing requests, supply required files, or otherwise delays production for more than 30 days, InkPig may cancel the order without refund for work already completed.

6. Intellectual Property Warranty

The Customer warrants that they own, or have the legal right to use, all Artwork supplied to InkPig.

The Customer indemnifies InkPig against all claims, losses, or damages arising from infringement of intellectual-property rights relating to Customer-supplied Artwork.

The Customer warrants that Artwork does not contain unlawful, defamatory, offensive, or infringing material.

7. Pricing and Payment

All prices are displayed in New Zealand Dollars and exclude GST unless stated otherwise.

Payment must be made in full at the time of ordering. InkPig will not commence production until payment has been received.

8. Delivery, Shipping, Risk, and Delays

Free standard shipping is available for orders over NZD $100 delivered within New Zealand only. Offer excludes booklet products and Bulk Orders. InkPig reserves the right to exclude orders that exceed standard shipping size or weight limitations.

8.1 Shipping Area

InkPig ships Products to New Zealand addresses only, including rural delivery. Delivery outside New Zealand is not available unless expressly agreed in writing prior to ordering.

8.2 Production and Dispatch

All Products are custom-made to order.

Production timeframes are estimates only and vary depending on Product type, order size, and finishing requirements.

• Standard production: typically 1–3 business days
• Larger or more complex orders: 5–10 business days or longer

Production commences once full payment is received and Artwork is confirmed as print-ready (or approved where a Proof is provided).

8.3 Delivery Timeframes

Once dispatched, estimated delivery times are:

• North Island (urban): 1–3 business days
• South Island (urban): 2–5 business days
• Rural delivery: allow an additional 1–3 business days

All delivery timeframes are estimates only and are not guaranteed.

8.4 Risk and Courier Responsibility

Risk in the Products passes to the Customer on Dispatch.

InkPig is not liable for loss, damage, or delay once Products are in the control of a third-party courier, or for delays caused by factors outside its reasonable control, including courier delays, rural delivery schedules, weather events, public holidays, supply-chain disruption, or equipment failure.

8.5 Shipping Charges

Shipping costs are calculated at checkout based on order size, weight, and delivery location.

Additional charges arising from incorrect or incomplete delivery details supplied by the Customer may be passed on to the Customer.

8.6 Delivery Issues

Any issues relating to delivery, including missing or damaged Products, must be notified to InkPig within 7 days of receipt. InkPig may require photographic evidence and courier documentation to assess any claim.

9. Refunds, Returns, and Reprints

All Products are custom-made to order.

Due to the customised nature of printed products, InkPig does not accept returns or provide refunds for change of mind.

Refunds, reprints, repairs, or other remedies may be provided where InkPig is responsible for a fault, including where Products:

• are materially defective; 
• are not produced in accordance with the approved Proof; or 
• do not meet reasonable commercial printing standards. 

InkPig is not responsible for:

• change of mind; 
• errors contained in approved Proofs; 
• issues arising from Customer-supplied Artwork; 
• low-resolution or incorrectly supplied files; 
• minor colour, trimming, alignment, laminate, or finish variations inherent in commercial printing processes; or 
• differences between on-screen colours and the final printed Product. 

Customers must inspect Products upon delivery and notify InkPig of any alleged fault, defect, or printing error within 30 days of delivery.

Where InkPig accepts responsibility for a fault, InkPig may, at its discretion and in accordance with the Consumer Guarantees Act 1993, provide an appropriate remedy including a reprint, repair, replacement, store credit, or refund to the original payment method.

Where a return is required due to a fault caused by InkPig, InkPig will cover the reasonable cost of return shipping.

To the maximum extent permitted by law, InkPig’s liability is limited to the value of the affected Product order and excludes indirect, consequential, or business losses.

Nothing in these Terms limits or excludes any rights the Customer may have under the Consumer Guarantees Act 1993.

10. Consumer Guarantees Act

Where Products are supplied for personal, domestic, or household use, the Consumer Guarantees Act 1993 applies.

Where the Customer acquires Products for business purposes, the parties agree that the Consumer Guarantees Act 1993 does not apply to the extent permitted by law.

11. Limitation of Liability

To the fullest extent permitted by law, InkPig’s total liability arising out of or in connection with any order is limited to the value of that order.

InkPig is not liable for any indirect or consequential loss, including loss of profits, business, or opportunity.

12. Subcontracting and Outsourced Production

InkPig may, at its discretion, engage third-party suppliers, contractors, or production partners to manufacture, finish, package, or deliver Products.

Where third parties are engaged, InkPig remains responsible for the overall coordination of the order but is not liable for delays, defects, or failures arising from circumstances beyond its reasonable control, including supplier disruption, equipment failure, or courier delays.

The use of subcontractors or third-party production partners does not relieve the Customer of their obligations under these Terms.

13. Force Majeure

InkPig is not liable for delay or failure to perform its obligations due to events beyond its reasonable control, including equipment failure, supplier disruption, courier delays, power outages, or natural disasters.

14. Account Misuse

InkPig may suspend or restrict access to the Website or refuse service where fraud, abuse, or misuse is suspected.

15. Privacy

InkPig complies with the Privacy Act 2020 (NZ). Personal information is handled in accordance with the InkPig Privacy Policy.

16. Governing Law

These Terms are governed by the laws of New Zealand. The New Zealand courts have exclusive jurisdiction.

17. General Provisions

Severability

If any provision of these Terms is held to be
invalid, unlawful, or unenforceable for any reason, that provision shall be severed, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

No Waiver

Failure by InkPig to enforce any right, remedy, or provision of these Terms shall not constitute a waiver of that right, remedy, or provision, nor shall it prevent InkPig from enforcing it at a later time.

Entire Agreement

These Terms constitute the entire agreement between InkPig and the Customer in relation to use of the Website and the purchase of Products, and supersede all prior discussions, representations, or understandings, whether written or oral.

Assignment

InkPig may assign, transfer, or novate its rights and obligations under these Terms at any time. The Customer may not assign or transfer their rights or obligations under these Terms without InkPig’s prior written consent.

18. Promotional Use

InkPig may photograph or reproduce completed Products for the purpose of promoting its services, including use on the InkPig website, social media, advertising, and marketing materials.

InkPig will not disclose sensitive or confidential information contained within Artwork and may omit or obscure personal details where appropriate.

Customers who do not wish their Products to be used for promotional purposes must notify InkPig in writing at the time of ordering.
